Yes, a 482 visa can lead to permanent residency in Australia. The Department of Home Affairs announced that all subclass 482 visa holders will be eligible to apply for permanent residency by the end of 2023.
A 482 visa is a Temporary Skill Shortage visa that allows employers to address labor shortages. Visa holders can stay for up to 2 years or up to 4 years if an International Trade Obligation (ITO) applies.have worked for the same employer for 3 years on your TSS 482 visa. have worked in the same occupation for the 3 years on your TSS 482 visa. have at least competent English (IELTS 6 in each band or equivalent)- exemptions apply. you are under 45 years old at the time of applying for PR.
TSS Visa holders who have been working in Australia with the same employer for three years may be eligible to apply for Permanent Residency through the Transitional Stream.
To be eligible to transition from TSS to permanent residency, your occupation must be on the medium long-term occupation list.
Depending on their location, TSS visa holders will apply through either the Employer Nominated Scheme (ENS) or the Regional Employer Sponsored Scheme (RSMS).
The employer must be willing to sponsor the applicant for permanent residency under the Temporary Residence Transition stream and must lodge a valid nomination with the Department of Home Affairs. This is one of the most common pathways to permanent residency and has many benefits.
The employer must also be willing to pay the Skilling Australian Fund (SAF) levy.
Medium-Term TSS 482 visa holders who have been working in Australia with the same employer for three years may be eligible to apply for Permanent Residency though the Transitional (TRT) Stream. Based on their postcode being regional or Metropolitan Australia, TSS 482 visa holders will apply through either the Employer Nominated Scheme (186 ENS) or the Regional Employer Sponsored Scheme (187 RSMS). The employer must be willing to sponsor the candidate for permanent residency under the Temporary Residence Transition stream and must lodge a valid nomination with the Department of Home Affairs (Previously the Department of Immigration). This is one of the most common pathways to permanent residency and gives you all the PR entitlements.
The Department has advised that these changes are expected to commence from 25 November 2023 subject to the approval of regulation changes. The eligibility period of employment on a TSS 482 visa has been also reduced from 3 years to 2 years of employment with the most recently approved sponsor.
